Probate & Estate Administration

Helping You Avoid Complications
Here at Muscat & Co, our priority when acting in any estate matter is to take the anxiety and stress out of the administration process.
For many families, the first question is, what happens next?
The answer is that it depends. In many instances, the first step will require an application for Probate through the Supreme Court.
This is the path through which the last Will is proven and executors are legally authorised to administer an estate. We have extensive experience in this process and can guide you through each of its steps.
In cases where no Will can be found, the law identifies certain classes of beneficiary who might claim an entitlement from an estate. Again, we know this Supreme Court application well and can assist you through each of its stages.
In addition to administration grants from the Court, we also assist in the transmission of real estate to next of kin, the redemption of assets from banks and other custodians, the sale or transfer of estate shareholdings, and the submission of claims for outstanding superannuation entitlements.
